The Licensing Support Officer presented a report to the Sub-Committee regarding a Temporary Event Notice (TEN) application.

 

On 15 March 2019, Ms Catherine Tyler submitted a TEN application to use Scrattons Farm Community Association.  The notice was to allow the sale by retail of alcohol to non-club members for consumption on the premises only, the provision of late-night refreshment and the provision of regulated entertainment on Saturday 30 March 2019.  The original application was for between the hours of 16:00 and 00:00 (midnight) however it was noted, and confirmed by the applicant, that there was an error on the application form and the TEN was for between the hours of 16:00 and 23:00.

 

The notice was required for the event as it was for non-members of the club and the Club Premises Certificate only allowed the sale of alcohol to members and bona-fide guests.

 

One representation had been received in respect of the application from the Metropolitan Police.  The representation was made under the grounds of the protection of children from harm as the applicant had stated that the event was for a one-year old’s birthday party.

 

The Chair invited PC Clay to address the Sub-Committee, setting out objections from the Police.  PC Clay advised that any children who were aged one to twelve years of age should not be within licenced premises and exposed to licensable actives and loud music to such a late hour.

 

The Chair then invited Ms Tyler to address the Sub-Committee.  Ms Tyler advised that:

 

-  The TEN was applied for so as to enable alcohol to be served to non-members of the club who had booked out the venue;

-  A family had booked the venue for a party and Ms. Tyler would be present throughout;

-  Concerns of noise nuisance were taken seriously, and noise would be monitored throughout the event as a DJ had been booked; and

-  A form had been completed by the hall booker, which stated the terms and conditions of the premises, and also stated that a maximum of 120 people could attend the event at one time.

 

The Chair invited all parties present to sum up their representations before the Sub-Committee retired to make its decision.

 

Decision

 

The Licensing Sub Committee had regard to the s.182 guidance and relevant legislation, and also had regard for the contents of the agenda and all matters stated in the hearing.

 

The Sub-Committee resolved to grant the TEN as sought, noting that it was sought until 23:00 on 30 March 2019 and not 00:00 (midnight), as indicated on the application.
